Terms of Use

EverKeeps ("we", "us", "our") is a mobile application that allows parents to photograph their children's artwork and use AI to animate it into short story videos. EverKeeps is developed and operated by Andrei Bersenyov ("Developer").

By downloading, installing, or using the EverKeeps app ("App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App.

These Terms form a binding agreement between you and the Developer. You must be at least 18 years old to create an account.

EverKeeps provides:

• A mobile app for iOS and Android to photograph and store children's artwork
• AI-powered animation of artwork into short story videos
• Cloud storage of memories, stories, and redraws
• Subscription-based access to premium features

AI animations and redraws are generated on demand and delivered as digital content within the App.

You must create an account to use EverKeeps. You are responsible for:

• Providing accurate registration information
• Keeping your credentials secure
• All activity that occurs under your account

You may register using email/password, Google Sign-In, or Apple Sign-In.

EverKeeps offers a free Starter plan and three paid subscription tiers:

Plan features are described in the App at the time of purchase. We reserve the right to change pricing for future billing periods with reasonable notice.

Subscriptions are billed through your Apple App Store or Google Play account. By subscribing you authorise the respective platform to charge the applicable fee at the start of each billing period.

Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You will be notified of the upcoming renewal via push notification 5 days and 3 days before the renewal date.

Cancellation: You can cancel at any time through your device's subscription management settings. Cancellation takes effect at the end of the current billing period — you retain access until then.

No refunds: Payments are processed by Apple or Google. Refund requests are subject to their respective refund policies.

Germany — Monthly Termination Right

Consumers in Germany have the right to cancel a monthly subscription with effect at the end of the current calendar month, regardless of when during the month the cancellation notice is received. After the initial subscription period, German consumers may cancel any subscription on a monthly basis. This right is exercised through the standard cancellation flow in the App Store or Google Play.

For consumers in the European Union, you have the right to withdraw from a contract for services within 14 days of conclusion without giving any reason (cooling-off period).

Exception for digital content: You expressly acknowledge and agree that once an AI animation or style redraw has begun processing at your request, the right of withdrawal for that digital content is lost, as performance of the digital content has begun with your prior express consent.

Exception for services fully performed: Where a service has been fully performed during the withdrawal period with your prior express consent, the right of withdrawal is lost.

To exercise the right of withdrawal for eligible purchases, contact us at support@everkeeps.app within 14 days of your subscription start date.

The EverKeeps app, including its design, code, and non-user content, is proprietary software owned by the Developer. All rights reserved. You are granted a limited, non-exclusive, non-transferable licence to use the App solely for its intended personal, non-commercial purpose.

Your content: You retain ownership of photographs and artwork you upload. By uploading content you grant us a limited licence to process it for the purpose of providing the service.

AI-generated content: Animations and redraws generated by the App are provided to you for personal use. We make no guarantees about the accuracy, quality, or fitness for purpose of AI-generated content.

You may not:

• Use the App for any unlawful purpose
• Upload content that infringes third-party intellectual property rights
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Use the App to generate or distribute content that is illegal, harmful, or obscene
• Share your account credentials with others
• Circumvent any technical measures or subscription restrictions

By you: You may delete your account at any time via Settings → Delete Account. This cancels your subscription at the end of the current billing period and permanently removes your data.

By us: We may suspend or terminate your account if you breach these Terms, if required by law, if you appear on a sanctions list maintained by the UN, EU, US OFAC, or any applicable authority, or if continued provision of the service becomes impossible due to circumstances beyond our control.

Your use of EverKeeps is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.

To the maximum extent permitted by applicable law, the App is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.

If you have a complaint, please email support@everkeeps.app first. We will endeavour to respond within 5 business days.

EU consumers may also submit complaints via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

These Terms are governed by applicable law. This does not affect any mandatory consumer protection rights you have under the law of your country of residence.

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
